ELIGIBILITY

The “UNDP Panda Ambassadors” Contest (the “Contest”) is open to individuals 18 years of age and older at the time of entry, and to individuals under the age of 18 years at the time of entry provided they are represented by a parent or legal guardian. Officers, employees, representatives and agents of the United Nations Development Programme (“UNDP”), the Chengdu Research Base of Giant Panda Breeding (“Chengdu Panda Base”), the China Wildlife Conservation Association, the Sichuan Province Wildlife Conservation Foundation, and the Chengdu People’s Association for Friendship with Foreign Countries, partner organizations and affiliates and their immediate family members and persons living in the same households as those individuals (whether related or not) are not eligible to enter the Contest.

AGREEMENT TO RULES

By submitting an entry, each entrant agrees to and warrants that his or her entry complies with the rules contained herein (the “Official Rules”). Entries violating the rules may be disqualified at UNDP’s sole discretion.

CONTEST PERIOD

The Contest begins on 16 May 2016 at 12:00 a.m. Eastern Standard Time (EST) and ends on 13 August 2016 at 11:59 p.m. Eastern Standard Time (EST) (the “Contest Period”). All entries must be received during the Contest Period and no later than August 13, 2016 at 11:59 p.m. Eastern Standard Time.

HOW TO ENTER

To enter the Contest, visit pandas.undp.org during the Contest Period, complete the entry form, including your full name, e-mail address. Qualified entrants should submit two name suggestions – one for each of UNDP’s Animal Ambassadors. They may also opt to submit, in addition, a short selfie video explaining which of the new Sustainable Development Goals (SDGs) are important to them and why in a fun and creative way (the “SDG Video”). All entries must be in line with the values of the United Nations and may not be profane, abusive, offensive, pornographic, defamatory or inappropriate as determined by UNDP in its sole discretion.

The SDG Video should not exceed 30 seconds. One entry per person only. Entrants who submit multiple entries will not be disqualified from entry, but will be entered into the Contest only once using their first entry. Once name suggestions and, if applicable, SDG Video, are submitted, individual is officially entered into the Contest. Contest entries cannot be revised or altered once submitted. Video entries uploaded to a video-hosting site must comply with the terms and conditions of use of such site. No third party entry or entry through automatic, programmed, robotic, contest service or similar means are permitted. The person uploading or submitting the entry will be deemed the entrant (“Entrant”). The Entrant is the one person who owns the email address associated with the video submission, except that an email address in the name of the parent or legal guardian of the otherwise eligible minor entering the submission will be permitted and the minor will be deemed the Entrant. If any group elects to collaborate on a submission, they are required to designate one person as the Entrant who will be the agent of the group to enter the Contest, agree to the rules, and, if applicable, accept the prize. Only qualified participants who submit SDG Videos, subject to the rules described herein, will be considered for a chance to be one of 17 UNDP Panda Champions and win a trip to the Chengdu Panda Base in Sichuan, China.

By submitting an entry you hereby warrant that: i) you own or have all the necessary licenses, rights, consents and permissions to submit your SDG Video to UNDP; and ii) you waive any moral rights in your SDG Video; iii) your SDG Video does not and shall not infringe the privacy rights, copyright or any other rights of any third party; and iv) any person portrayed in your SDG Video has given permission (or, where the SDG Video shows any persons of minor age, their parent/guardian has given permission) for the usage rights required by the competition and contained herein.

PRIZES

Winners of the Contest will be offered a chance to visit the Chengdu Panda Base in Sichuan, China on a date to be determined by UNDP and the Chengdu Panda Base. Trip package includes: economy class international return air fare for the Winner (and one parent or legal guardian if the winner is under the age of 18) from their country of residence to China; connecting economy domestic flights within China to Chengdu; 3 nights hotel accommodation; ground transportation to and from Chengdu Panda Base; subsistence allowance. Details of the trip package may be modified by UNDP and the Chengdu Panda Base at any time at their discretion. All expenses and incidental travel costs not expressly stated in the description of the trip herein, including but not limited to, incidentals, gratuities, passenger tariffs or duties, airline fees, surcharges, airport fees, service charges or facility charges, personal charges at lodging, security fees, taxes or other expenses are the responsibility solely of winner. The prize is non-transferable and may not be redeemed for cash value. No prize substitution permitted, except at the discretion of UNDP and the Chengdu Panda Base. Acceptance of prize constitutes permission for UNDP and its designees to use winner’s name, likeness and entry without further compensation. If the individual selected declines to participate or is unable to fulfill Contest requirements or if, by reason of accident, illness or emergency, the person is unable to travel or must return home early, or if the individual’s participation is terminated by UNDP prior to trip completion, there will be no cash compensation.

SELECTION AND NOTIFICATION

Each eligible entry will be considered by a panel of judges that shall include representatives of UNDP, the Chengdu Panda Base and an independent panelist. The winning names and SDG Videos will be selected by the panel based on the following criteria: originality 20 %, style 20%, creativity 20%, and effectiveness in promoting the Sustainable Development Goals 40%. The winning names and SDG Videos will be announced on or before 25 August 2016, subject to change by UNDP.

UNDP will notify potential winners of a trip to the Chengdu Panda Base on or before 10 August 2016, subject to change by UNDP, using the e-mail addresses provided on the entry. At the time of notification, UNDP shall also request the potential winner to provide an original video file of the content submitted and subsequently chosen as a winning entry. Potential winner must respond to such notification and submit the original video file within five (5) business days of the first notification attempt. Noncompliance within this time period, failure to submit such file, any notification returned to us as undeliverable may result in disqualification and selection of an alternate winner.

UNDP may in its discretion announce the name(s) of one or more potential winners on its website or in other forms of communication, provided that no potential winner shall be certified a winner until the potential winner or the winner’s parent or legal guardian[W2] has executed and returned list here required documents for signature: a release and affidavit / an Affidavit of Eligibility, Confidentiality Agreement, Release of Liability, and, if legally permissible, a Publicity Release, waiver within five (5) business days of attempted delivery of same.

UNDP reserves the right to conduct a background check on each of the winners. Each potential winner consents to the same and shall provide whatever additional information, permission, and/or documentation is required or requested by UNDP in connection with the same.

In the event a winning entry is discovered to be invalid for any reason whatsoever or the potential winner fails to comply with these Official Rules prior to delivery of the corresponding prize or does not meet the eligibility or other requirements of the Contest, such prize may be forfeited and awarded to an alternate winner selected from the remaining eligible entries at UNDP’s discretion.

RIGHTS TO USE AND MODIFICATION

Submission of an entry constitutes consent and agreement by the Entrant and any person that is recognizable from the SDG Video to a worldwide, non-exclusive, royalty-free, sub-licensable, unconditional, perpetual and transferable right and license to UNDP and its designees to use, reproduce, distribute, prepare derivative works of, and display, broadcast, or webcast the materials submitted, not for commercial purposes, but for purposes of the competition and any related public service activities whatsoever. UNDP and its designees can use the material submitted in any way it deems suitable for its activities including and not limited to adding our logo to the materials. You will have no right of approval, no claim to any compensation and no claim arising out of the use, alteration or dissemination of such materials. All submissions become the property of UNDP. Entrant also agrees to forfeit rights of privacy, intellectual property rights or other legal or moral rights that would preclude UNDP or its designees from using the materials submitted to it for its activities and agrees to never sue or assert any claim against UNDP’s and its designees use of those materials.

CONDUCT OF UNDP PANDA CHAMPIONS

UNDP Panda Champions must conduct themselves in a manner that is in keeping with the values of the United Nations and the United Nations Code of Conduct. UNDP reserves the right to cancel or reschedule the trip, in whole or in part, in its sole discretion, to dismiss the winner from further participation in the trip as a result of conduct that is considered improper or offensive, is likely to be detrimental to the health or safety of the winner or other individuals, or demonstrates that the individual is not capable or unwilling to participate fully in the trip experience.

USE OF PERSONAL INFORMATION

Participants will be asked to share their full name and e-mail address in order to submit an entry to the Contest. UNDP will store this information securely and will not share it with anyone other than UNDP partner organizations. UNDP reserves the right to use names and e-mail addresses submitted by contest Entrants for promotional or notification purposes related to the Contest, as well as for purposes that include provision to you of information on fundraising activities and appeals for donations, or information about UNDP and its activities, without additional notification, consideration, compensation or right of review.

LIMITATION OF LIABILITY / RELEASE

You acknowledge and agree that UNDP, the Chengdu Panda Base, the China Wildlife Conservation Association, the Sichuan Province Wildlife Conservation Foundation, and the Chengdu People’s Association for Friendship with Foreign Countries, and its respective officers, employees, agents and representatives will not be liable for any personal injury, death, loss or damage of any kind or any other causes of action or claims related to the conduct of, or your participation, in this Contest, or acceptance or use of the prize awarded, and/or claims based on publicity rights, defamation or invasion of privacy.

You acknowledge and agree that UNDP will not be responsible for any problems of any kind whether mechanical, human or electronic, including, but not limited to computer, network, electronic, hardware or software malfunctions, failures, connections, availability or jumbled transmissions, or service provider or website accessibility or availability, traffic congestions or unauthorized human intervention that could corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest.

UNDP reserves the right to suspend, cancel, terminate or modify the Contest without advance notice in the event UNDP believes, in its sole discretion, any such problem has occurred and thereafter to re-commence such Contest, if at all, only at such time(s) and upon such terms and conditions as UNDP shall deem reasonable under the circumstances.

Nothing in these Official Rules shall imply a waiver by UNDP, the United Nations or any of its Agencies or Organizations of any privileges or immunities enjoyed by them under the 1946 Convention on Privileges and Immunities of the United Nations, the 1947 Convention on Privileges and Immunities of Specialized Agencies, customary or international law, international or national agreements, or local law, nor would constitute or be construed as their acceptance of the jurisdiction of the courts of any country over disputes arising out of these Official Rules.
